POSSESSION CUM SALE NOTICE

Whereas the Authorised Officer of the PUNJAB & SIND BANK under the SARFAESI

Act,2002 and in exercise of powers conferred under section 13(12) read with rules of the

Security Interest (Enforcement) rules,2002 issued a demand notice dated 25.02.2005

under Section 13 (2) calling upon the borrowers/guarantors to repay the amount

mentioned in the notices within 60 days from the date of notice. As the

borrowers/guarantors have failed to repay the amount mentioned in notice, notice is

hereby given to the following borrowers/guarantors and the public in general that

respective Authorised Officer has taken possession of the property/ies in exercise of

powers conferred on Authorised Officer under Section 13 (4) of the said Act read with

relevant Rules on the date stated herebelow.

Pursuant to the possession taken by the Authorised Officer under SARFAESI Act,2002

for recovery of the secured debts of Punjab & Sind Bank mentioned against the

borrowers detailed hereunder and interest thereon from date mentioned therein and with

costs and charges, offers are invited by the Authorised Officer in sealed cover for

purchase of under noted property/ies on “AS IS WHERE IS BASIS” as per brief

particulars given hereunder.

This may also be treated a Notice of Sale of properties to following borrowers and

guarantors under Rule 8 (6) of the Security Interest (Enforcement) Rules, 2002.

Public Notice dated 05.05.2009 inviting Bids

Terms & Conditions of Sale:

1. Properties could be inspected after fixing a suitable date and time with the

Authorized Officer/Branch Manager,Jabalpur.

2. All the intending bidders should send their bids in a sealed cover super scribed as

BID/Tender a/c M/s Santosh Jaiswal alongwith an EMD (refundable without

any interest to unsuccessful bidders) only by way of Demand Draft/Pay Order

issued in favour of Punjab & Sind Bank A/c M/s Santosh Jaiswal payable at

Jabalpur so as to reach Punjab & Sind Bank, Jabalpur on or before

13.06.2009 by 2 p.m.

3. The sealed covers will be opened by the Authorised Officer at Jabalpur branch

in the presence of available/intending bidders on 15.06.2009 at 11.30 a.m.

4. The amount so deposited as earnest money deposit (EMD) will not carry any

interest.

5. No person who had not deposited the EMD as aforesaid will be permitted to

participate in the said auction.

6. The successful bidders will immediately be required to deposit 25% of the sale

price by way of cash/Pay Order/DD after adjusting the EMD already paid. Upon

failure of the highest bidder to immediately deposit 25%, property(ies) will be reauctioned

and sold to the next highest bidder or cancelled and EMD of the

previous highest bidder shall be forefeited forthwith.

7. The balance amount (75%) of the sale price to be paid within 15 days of the

confirmation of the sale or such extended period as permitted upon in writing by

the Authorised Officer. In case of failure to deposit the balance amount of sale

price within the prescribed period, the amount deposited as per clause 6 herein

above shall be forfeited.

8. The Authorised Officer is not bound to accept the highest offer or all the offers

may reject the same without assigning any reason thereof. In case of such

rejection, the Authorised Officer can negotiate with the highest bidder or other

parties for sale of the properties by Private Treaty.

9. All attendant charges including registration, stamp duty/taxes etc shall be

exclusively borne by the purchaser.

10. Authorised Officer reserves the right to accept or reject any bid or postpone or

cancel the auction or opening of the tenders without assigning any reason and also

to modify any terms & conditions of the sale without any prior notice.

11. The secured creditor does not in any way warrant the fitness quality or use ability

of the properties being sold.

12. After opening the tenders, the intending bidders may be given an opportunity, at

the discretion of the Authorised Officer to have inter-se bidding among

themselves to enhance the offer price.
