Tender Conditions:

1. Tender forms are not transferable and the cost of the tender form is not refundable.

No cash transactions will be entertained.

2. Original Computer Print of the Tender Documents down loaded from the website are

only accepted. Photocopies of down loaded Tenders Papers are liable for rejection.

Any changes / additions / deletions in the tender documents down loaded from

Website, will make the offer invalid and the railway will forfeit the earnest money

deposited by the tenderer.

3. The Earnest Money Deposit should be deposited in the shape of Demand Draft

drawn in favour of Senior Divisional Finance Manager/ South Central Railway/

Guntakal (OR) money receipt obtained from the Divisional Cashier/ Pay/ South

Central Railway/ Guntakal, the specified amount should be submitted along with

tender. This deposit is not acceptable in the form of Bank Guarantee. Tenders

without requisite EMD shall be summarily rejected.

4. If the stipulated day for opening of the tender happens to be a holiday, the tenders

will be opened on the next working day at the same time and venue.

5. The Railway reserves the right to discharge the tender without assigning the reasons.

6. Railway is not responsible for any printing mistakes in the tender notice. The

Tenderes should visit the Web site / Contact the undersigned office for clarification if

any.

7. Tenderers shall enclose all the requisite credentials such as Technical and Financial

documents to evaluate their offer.

i. Should submit Electrical Contractors Licence issued by State Electrical Licensing

Authority attested by a Gazetted Officer / State / Central Government to be

submitted along with the tender.

8. Electrical Contractors license either in the Name or the Firm / Managing Partner who

AGREEMENT FOR WORKS

Central Railway, Guntakal (herein after called the ‘Railway’ which expression shall,

unless the context does not so admit include his successors and assignees in Office)

(hereinafter called the ‘Contractor' which expression shall unless excluded by the

context include his heirs, executors, administrators, successors and assignees) of

the other part.

2. WHEREAS THE Contractor has agreed with the Railway for the performance of the

and the specifications of the South Central Railway and the Special conditions and

5. NOW THIS INDENTURE WITNESSETH that in consideration of the payments to be

made by the Railway, the contractor will duly perform the said works in the said

schedule set forth and shall execute the same with great promptness, care and

accuracy with good workmanship to the satisfaction of the Railway and will complete

the same in accordance with the said specifications said Drawings and said

conditions of contract within ______ days from the date of issue of letter of

acceptance No. G/E.29/I/______ dated _____________ on or before ___________,

and will guarantee / maintain the said works for a period of twelve calendar months

from the certified date of the completion and will observe, fulfill and keep all the

conditions therein mentioned, (which shall be deemed and taken to be part of this

contract as if the same has been fully set forth herein), and the Railway doth hereby

agree that if the contractor shall duly perform the said works in the manner aforesaid

and observe and keep the said terms and conditions, the Railway will pay or cause to

be paid to the Contractor for the said works on the final completion thereof the

amount due in respect thereof at the rates specified in the schedule hereto annexed

for a total amount of Rs.__________________.

6. The Railways reserves the right to appropriate the Security Deposit required in the

terms and conditions of the tender against non-fulfilment of the contract without

prejudice to any other rights or remedies. The Security Deposit will be with held by

the Railway until the expiry of the aforesaid guarantee / maintenance period.

7. It is hereby agreed and declared that all the provisions of the said specifications,

conditions of contract which have been carefully read and understood by the

contractor and the schedule of Rates, including the General Instructions contained in

this Tender document thereof shall be as binding upon the contractor and upon the

Railway as if the same had been repeated herein and shall be read as part of these

presents

GENERAL INSTRUCTIONS TO TENDERERS

1. The president of India invites open Tenders, through Divisional Railway Manager

(Electrical), South Central Railway, Guntakal for the above work detailed in the

tender document.

2. Sealed tenders will be received by Divisional Railway Manager (Electrical)

S.C.Railway, Guntakal up to 12-00 hours on ________________ and will be opened

at 12-30 hours on the same day.

3. The Tenders must be accompanied with the standard Tender schedules duly filled in

and signed complete with Technical details, Drawings, description, literature etc.,

without which no tender will be considered. Complete tender documents shall be

submitted duly singed in each page.

4. The rate quoted must be firm and subject to fluctuations No taxes will be paid by the

Railways due to fluctuation etc., at later date.

5. The Tenderer shall keep the offer open for a period of 90 days from the date of

opening of the tender within which period the Tenderer cannot withdraw his offer. If

required the period may be extended further, by mutual Agreement from time to time.

Any contravention of the above condition will make the Tenderer liable for forfeiture

of his Earnest Money Deposit.

6. The President of India is not bound to accept the Lowest offer not assign the reason

for doing so and the President of India reserves the right to accept any Tender in

respect of the whole or any portion of the item specified.

7. A sum of Rs.____________/- as earnest money must be deposited with the

Divisional Cashier (Pay), South Central Railway, GUNTAKAL without which the

Tender will not be considered. This Deposit shall be made either in cash receipt or in

the shape of demand draft drawn in favour of Sr. Divisional Finance Manager /

S.C.Rly. / Guntakal, No interest will be allowed on this Deposit and the President of

India reserves the right to confiscate this Deposit should be successful tenderer fail

to put in the Security Deposit required by the terms and conditions of the Tender.

Tenders, unaccompanied by Earnest Money will be summarily rejected.

8. No alternation in the rates specified in the Tender shall be allowed unless it has been

initialled by the Tenderer before the submission of the Tender. The rates shall be in

figures and words.

9. Any deviation if necessary from the attached schedule of requirements will be

adjusted by mutual agreement.

10. The work shall be completed within _________ days from the date of issue of

acceptance letter.

11. The tenderer shall be required to visit the site, by prior appointment with the

authorised Representative of Divisional Railway Manager (Electrical), South Central

Railway, Guntakal and as certain himself regarding the local conditions storage

facilities, extent of work and other limitations. The tenderer should also aware of the

Rules mentioned in the Railways general condition of contract.

12. In all matters of dispute, the decision of the General Manager (Electrical) South

Central Railway / Secunderabad, shall be final and binding.

13. Tender should be submitted for the entire work.

14. No free passes will be issued by the Administration to the Contractor.

15. The submission of the Tender will be deemed to imply that this memorandum and all

documents enclosed have been studied and understood and that the Tenderer is

aware of the full scope of the work to be done.

16. The Tenderer shall have to execute all agreement with the Railways for executing the

work as tendered and accepted by Railways.

17. If the Tenderer deliberately gives wrong information in this Tender for the acceptance

of the Tender, the Railways reserves the right to reject such Tender at any stage.

18. No unsealed tender will be accepted.

19. Tenderer should submit the authorisation letter from the principal in original allowing

him to quote for this particular tender, along with the tender that, they are authorised

stockists/dealer for the approved brands mentioned in the tender, otherwise his

tender will be disqualified.

20. The contractor / Agency shall note that, the Contractors / Agency shall engage an

Engineering Graduate for the works costing Rs.15 lakhs and above and one qualified

Diploma Holder (over/seer) for the works costing more than Rs. 5 Lakhs and less

than Rs.15 Lakhs. If the contractor fails to employ the Technical staff as afore said,

he shall be liable to pay a reasonable amount not exceeding a sum of Rs.5000/-

(Rupees Five thousands only) for each month of default in case of Graduate

Engineer and Rs.3000/- (Rupees Three thousands only) for each month of default in

case of Diploma Holder (Over-seer).

The Contractor / Agency shall also notify to the department regarding the

engagement of a Graduate Engineer or Diploma Holder as the case may be with

their details.

SOUTH CENTRAL RAILWAY

GENERAL CONDITIONS OF CONTRACT

[ To be returned along with the Tender ]

The General condition of Contract governing the performance of the work covered by

this contract is the ‘General Conditions of Contract’ for the use in connection with Civil

Engineering works of South Central Railway as amended from time to time up to date.

A copy of the Book-let incorporating the above ‘General Conditions of Contract’ may

be pursued or purchased from the Office of Sr. Divisional Electrical Engineer, South Central

Railway, Guntakal.

As far as General Conditions of Contract of Electrical portion of work is concerned,

this may be pursued in the office of the Sr. Divisional Electrical Engineer, South Central

Railway, Guntakal.

In submitting this tender, it would be deemed that the tenderer has kept himself fully

informed of the provisions of the General Conditions of Contract including all corrections and

amendments issued up to the date of tender notice.

I / We have gone through the General conditions of contract governing the

performance of work covered by this Tender.

I / We have kept myself / our selves fully informed of the provisions of these general

conditions. In token of acceptance I / we ,am/are appending my/our signature below.

GENERAL CONDITIONS OF CONTRACT

Definition of terms:

1. In constructions these General conditions specification annexure Schedules and

appending the following words shall be the meaning herein assigned them unless in

consistent with the tests.

a. The President shall mean the president of India and shall be deemed to included the

Chief Electrical Engineer/South Central Railway, Secunderabad for the time being

and officer deputed by him.

b. The Railway shall mean the South Central Railway.

c. The Chief Electrical Engineer shall mean the Chief Electrical Engineer, South Central

Railway, Secunderabad, as the officer appointed to supervise the work on behalf of

the president of India.

d. 'Supply' or 'supplies' shall means and includes the whole of the work to be done

executed carried out and the equipment and materials to be provided by

Contractor(s) under the contract in accordances with Schedule 'A'.

e. The sites shall mean the South Central Railway station and the surrounding area at.

Intimation:

2. The Contractor(s) must obtain in for himself/ themselves of his/ their own

responsibility and at his/ their own expenses all the information which may be

necessary for the purpose making a contract and for entering into a contract and

inspect the site of the work and equipment himself/ themselves with all works nature

of work and materials to the meet with and all matters pertaining thereto.

Quotation:

3. The Contractor(s) must quote his/ their rates with reference to each item and must

tender for all the items shown in the schedule. The cost column in all the said

schedule must be filled up in words and figures.

3. a. The tender shall keep the offer/open for minimum period of 90 days from the date of

opening of the Tender within which period the tenderer cannot with draw his offer

subject to the period being extended further if required by mutual agreement from

time to time. Any contravention of this will take the tender liable for forfeiting his

Earnest Money.

4. The duration of the contract is from the contract singed until the work is completed.

5. Up on the completion of the work, the president will pay the Contractor(s)at the

accepted rates in the schedule in the manner provided by clause 18 itself.

6. The drawing supplied will represent the form and dimensions of the work to be

carried out where any discrepancy exists between the dimensions as indicated by the

scale and dimensions marked in figures the figures are to be considered as correct

and are to be taken in all cases in preference to measurements by the scale given

and their should be any discrepancy between the figurers in the dimensions and

materials given in the description of work, scope of work schedule of requirements

and specifications, direction of the Chief Electrical Engineer shall be binding. Further,

anything contained in the drawing and not in the scope of work, schedule of

requirements and specifications, and not shown in the drawings, shall be equally

binding as if it was contained in both.

7. For the purpose of the execution of the contract, the contractor(s) shall arrange and

supply all the necessary materials and shall carryout the work with his/ their own

labour and supervision. He/ they shall also provide his their own auxiliary equipments

tools etc., at the site of work, except for Electric current at 230/ 440V single/ three

phases 50 cycles at the site of work, the contractor(s) shall not be given any other

assistance of any form by the Railways.

8. a. If the contractor(s) shall fail to execute the work, with due diligence and expenditure

or shall refuse, neglect or fail to comply with any others given to them by the Chief

Electrical Engineer, in accordance with the provisions of the conditions, the Chief

Electrical Engineer shall be at liberty to given notice in writing to the contractor to

make good the neglect, omission, failure, or breech/ compliance within a period to be

specified in such notice.

b. Any notice, by the Chief Electrical Engineer to the contractor(s) shall be deemed to

be duly served if given in writing addressed to the contractor(s) and delivered or sent

by registered post to the contractor(s) at their registered office address.

c. Should the contractor(s) fail to comply with any such notice within a period specified

as aforesaid the president shall be entitled to take the work of any portion of it out of

the contractor(s) and to re-contract with any other person or any other arrangements

for the completion of the work and may be use all or any of the materials tools, tackle

or other things which may then be the purpose of completing the work or any parts

thereof and promise any additional materials, tools or tackle required for the purpose.

The cost of execution any such work or providing any such materials shall be paid by

the contractor(s) to the president on demand or be deducted from any money due to

them by the president.

d. If the contractor failed to start the work within one month of signing the agreement,

his/their Security Deposit will be forfeited and the contract shall be cancelled.

e. The president may be determine and the contract at any time should stoppage of the

work become necessary, owning to want of funds or from any other cause,

whatsoever, in which the value of approved work done to date at the accepted

schedule-rates, will be paid in full and no claim shall lie against the president for

compensation for loss to the contractor due to orresing of the contract. The decision

of the president in this matter will be final.

EXTENSION OF TIME FOR EXECUTION OF WORK:

9. If such failure as aforesaid shall have arisen from any cause which the Chief

Electrical Engineer may admit as reasonable ground for extension of time the Chief

Electrical Engineer shall allow such additional time as he consider to be justified by

the circumstance of the case and shall from the whole/or such part as he may

consider reasonable of the claim for such loss / damage foresaid.

10. The work of supply, erection and maintenance shall for the purpose of all the

provisions of these conditions deemed to have been duly completed when the Chief

Electrical Engineer or any officer on his behalf shall be certified in writing that have

been completed in accordance with the contract conditions and such certificate shall

not be un-reasonable withheld not shall the Chief Electrical Engineer delay its issue

on account of commission or defects with in his opinion are minor but such issue

shall be with out prejudice to the contractor(s) liability to make good any such

commission and defects with the greatest possible expenditure.

Security Deposit.

11. The amount to be recovered from the progressive bills of the contractors at the rate

of 10 % till it reaches the required value.

Earnest money shall be held as Security deposit for the due and complete fulfilment

of the contract.

11 (a) Performance guarantee

Apart from the Security deposit, the contractor should furnish performance guarantee

in the form of an irrevocable Bank Guarantee / FDR amounting to 5% of the

contract value. The performance guarantee should be furnished before signing of

the agreement and should be valid up to the expiry of the maintenance period. The

P.G. shall be released after satisfactory completion of the work and maintenance

period is over. In the event of contractor(s) failing to make the deposit within the time

and in the manner aforesaid the Railway shall be entitled to cancel the contract and

forfeit the Earnest Money Deposited by the contractor(s) on or before the time on

submitting his/ their tender.

Sub-letting of the contract:

12. The contractor(s) shall not without the consent in writing of the Chief Electrical

Engineer, sub-let the contract or any part thereof. In the event of contractor(s)

subletting or assigning the contract, or any part thereof without such permission, the

Chief Electrical Engineer, Secunderabad shall be entitled to cancel the contract and

make arrangements for the execution of the work on the contract shall be liable for

any loss of damage which the Chief Electrical Engineer, Secunderabad may sustain

inconsequence of any arising out of such arrangements.

13. No Railway passes for the conveyance of labour by train and for the use of

contractor(s) or his / their agents be granted.

DAMAGES FOR DELAY IN COMPLIANCE:

14. If the contractor(s) fail to carry out, execute and complete the work-given to him /

them under this contract, the contractor(s) within the time, guaranteed by them / him

in schedule and without preference to the right of president under clause 8 of

contracts agreement to accept a reduction of Rs.50/- per day delay between the

appointed time and actual time for completing the work, under the terms of this

contract and such reduction shall be in the full satisfaction of the contractor or liability

for delay but shall not in any case exceed 25% of the contract value of the work.

15. The Contractor shall not alter any of the work without the sanction in writing from the

Chief Electrical Engineer, Secunderabad, but the president shall have full power to

alter amend, or otherwise vary any of the work without any way violating the contract

and the contractor(s) shall carry out all such alternations amendments or variations

and be found by the same conditions so far as applicable as though the said formed

part of the contract. The difference in cost if any due to such alterations amendments

variations shall be added to or deducted from the contract price as the case may

required. The president shall not become liable for the payment of any cheques in

respect of any such alterations, amendments to variations unless the order for

instructions or the performance of the same have been given in writing by the Chief

Electrical Engineer/ S.C.Rly./ Secunderanad. Sr. Divisional Electrical Engineer/ M/

S.C.Railway / Guntakal and until the same is endorsed in the Agreement and

incorporated in a formal instrument in and signed by the parties thereto.

Reasonability for damage to Railway property:

16. The contractor(s) shall be held responsible for all damages, which may be caused

done by him / them to the property of the president or to any person during the

execution, of such work.

17. The Chief Electrical Engineer, Secunderabad or his duly authorised deputes shall

have the power to inspect the work during the progress.

18. a. Terms of payment:- Please see clause No.12 of special conditions of contract unless

otherwise agree upon between the contractor and the purchaser payment will be

made by the Senior Divisional Finance Manager/ Guntakal.

b. The contractor shall make good any defects imperfections or faults or damages

caused due to defective workmen ship or due to a defective equipment, which may

appear or occur the maintenance period of 12 months at his own cost within 14 days

from the date of advise.

c. The maintenance period shall commence from the date of satisfactory, Completion of

the entire works as per contract, fusing of bulbs are however, not covered under this

Guarantee, The Security Deposit will be refunded if the contractor produces for

equipment amount which will be deposited with the Railway Administration for the

Maintenance period or One year.

Workmen Compensation:

19. Workmen compensation Act, Factory Act (including all the provision of same) and

payment of wages Act. The Contractor(s) shall keep the president at all times

indemnified and protected against all claims and liability that may be made under the

workmen's compensation Act, 1928, the factories Act 1948 and the rules made there

under from time to time.

20. Rents Right etc.:- The Contractor(s) shall keep the president fully and effectively

indemnified against all actions suits claims demands cost, charges and expenses

arising from or incurred by reasons of any infringement of any letters, patents

designs, trade mark of copy right of other protected right in respect of any machine

plant work, materials thing of system of method of using fixing working or

arrangements used fixed or supplied by the contractor All realities actual duties,

terminal and other payments which may have to be paid in respect of any such

machine, plant work materials thing, system or method as aforesaid (whether

payable in one sum or by installments or otherwise) are included in the contract price

and shall be payable the contractor.

In the event of any claims or demand being made or action or suit brought against

the President in respect of any such matter or matters as aforesaid the contractor(s)

shall be duly notified there of that settlement of such claims, or demands and for the

defence of any such action or suit subject if any so far as the President shall think

proper and expense of the Contractor(s) to his supervision and control by the

President through the Officer duly authorised in this behalf, or in connection with the

contract, whether during the period, they shall be responsible for all the negotiations.

21. The work shall be executed in all respects in the most and workmen are like manner

and to the entire satisfaction of the Chief Electrical Engineer who reject any work

which is his opinion be defective in quality or workmanship and any rejection also

shall be final and conclusive.

Insolvency or death:

22. Contractor(s) die or deemed a bankrupt or have a receiving order made against him /

them or make or enter into any arrangement or commitment with him their credit or

creditor or creditors suspend payment or being accompany a liquidation either

compulsorily or voluntarily the president shall have to the poor determines the

contractor and the Contractor(s)shall be liable for expenses loss or damage which

the president may incur reasons of the Contractor(s) shall be liable for expenses loss

or damage which the president may incur reasons of the contractor(s) default and

president shall retain and supply and sum which may be due to the contractor(s) for

payment of cost for completing the work.

Matter finally determined by the Railway:

23. All disputes and difference of anything whatever arising out of the progress of the

work, or after completion and whether before or after the work determination of the

contract, shall be referred to by the contractor to the Railway and the Railway shall

within a reasonable time after there. presentation make and notify decision a

classifications measurement drawing and certificates with respect to any matter,

special conditions, given specially provided for these or other Engineer on behalf of

the Railways are matters are referred to here in after as expected matters and shall

final and binding upon the contractor shall not be set aside on account of any

informity commission delay or error in receding in or about the same or any other

ground or for any other reasons and shall be without appeal.

Demand for arbitration:

23.1 In the event of any dispute of difference between the parties hereto as to the

construction or operation of this construction or their respective rights liability of the

parties on any matter in Question, dispute or difference on any account, or as to the

within holding by the Railway or any certificate to which the contractor may claim to

be entitled to the Railway fails to make a decision within a reasonable time, then and

in any such case, but except in any of the expected matter referred to in rule 23 of

these conditions, the contractor after 90 days of his presenting his final claim on

disputed matter may demand in writing that the dispute or difference by referred to

arbitration such demand for dispute of difference and not other shall be referred to

arbitration.

Obligation during pendency of:

23.2 Work under the contract shall unless otherwise directed by the Engineer continue

during the arbitration proceeding and no payment due for payable by the Railway

shall be withheld on account of such proceeding provided, however, it shall be upon

for the Arbitrator or arbitrator to consider and decide whether or not such work should

continue during arbitration proceedings.

3. a. Matter in Question of dispute of difference to be arbitrated upon shall be referred to

decision to.

Arbitration: A Sole arbitrator who shall be General Manager or a person nominated

by him is that behalf in case where the claim in question is below Rs.50,000/- and in

case where the issue involved are not of completed nature the General Manager

shall be the sole judge to decide whether or not the issue involved are of a

complicated nature.

ii. The arbitrators, who shall be Gazetted Railway Officers of equal status to be

appointed in the manner laid down in clause 3 (b) for all claims of Rs.50,000/- and

above for all claims.

Irrespective of the amount of value of such claims if the issue involved are of a

complicated nature. The General Manager shall be the sole judge to decide whether

the issues and of complicated nature or not in the event of the two arbitrators being

decided in their opinions, in the matter under dispute will be referred to an impute to

be appointed in the matter laid down in clause(s) for hid decision.

23.3.b. For the purpose of appointing two arbitrators are referred to sub clause (i) (iix) above

the Railway will send a panel for more than three names of Gazetted Railway officers

of the Railway to the Contractor who will be asked to suggest the General Manager

one name out of the list for appointment as the contractor's nominee will also appoint

a second arbitrator as so entering upon the reference, the two arbitrators shall

nominates an impure who shall be a Gazetted Railway Officer to whom the case will

be referred in the event of any difference between the two arbitrator.

23.3.c. If the sole arbitrators appointed under sub-clause (a) If the sole arbitrators appointed

under sub-clause (b) above resigned his appointment / resign their appointment or

vacates his office/vacate their offices or is/are unable or unwilling to act for any new

arbitrator / arbitrators to act in his/their place in accordance with the provision of subclause

(a)(1) - Sub-clause (b) above as the case may be such arbitrator / arbitrators

as the case may be shall be entitled to proceed with the reference from the stage at

which it was left by the previous arbitrator / arbitrators.

23.3.d. The Arbitrator or arbitrators and the umpire shall have power to call for such

evidence by way of affidavit or otherwise as the arbitrator or arbitrators of umpire

shall think proper and it shall be the duty of the parties thereto do or cause to be

done all such things as may be necessary to stage at which it was left by the

previous arbitrator / arbitrators. enable the arbitrator or arbitrators or umpire to make

the ward without any delay.

23.3.e. It will be no objection that the person approved as Arbitrator, arbitrators umpire the

Government servants. They have expressed the views on all any of the matter this

clause.

23.3.f. Subject, as aforesaid, Arbitration Act, 1940 and the rules there under and any

statutory modification there to shall apply the Arbitration proceedings under this

clause.

24. Any bribe, commission, Gift, or advantage gives / promised or offered by the or on

behalf of the contractor on parent / agent or servant or any on behalf of the contractor

on their behalf in relation to the obtaining or the execution of his or any other

contractor with the President shall in addition to any criminal liability he / they may

incur subject to the contractor(s) to cancellation of this and all other contractors with

the President and also to payment of any loss from such cancellation the President

shall be entitled to deduct to amounts to payable from any money otherwise due to

contractors under this or any other contractor, any Question of dispute as to the

commission of any offence under this clause shall be decided by the president in

such a manner and on which (X) decision shall be final (x) evidence or information as

he think and sufficient and his decision shall be final.

25. The Chief Electrical Engineer or his authorised representative shall have the right to

refuse Administration into the sites or any persons / employee by the contractor(s)

whom he may consider undesirable.

Claim against Contractor:

26. The president reserves the right to refuse right and is at liberty to set of against any

payment due to the contractor(s) of his contract amount of any other claim

whatsoever.

Surplus materials:

27. No surplus materials left over on completion of work against items or schedule will be

paid for by the Railway. The contractor shall remove all his / their plant and

equipment from the Railway premises within 15 days of termination of contract from

the site to the satisfaction of the Railway.

28. The Contractor shall exercise the greatest care, skill during the progress of

dismantling the existing equipment, which shall be done in the presence of and to the

entire satisfaction of any Authorised representative of the Chief Electrical Engineer.

He shall not hamper with there leased, materials and shall hand them over to the

authorised representative and shall fix up suitable dates and timing for these purpose

with the permission of the Chief Electrical Engineer.

29. The Contractor(s) shall carryout all necessary cutting away and making good for the

purpose of the contract of all wood works, walls, floors etc., of Railway buildings, the

contractor(s) shall be responsible and shall make good at his / their expenses to the

buildings which may be caused by the acts of commission of the contractor his

servants or against in connection with the contract. Commission of the contractor of

his servants of agents in connection with the contractor.

30. Observation to Rly. Staff:

Observations to Railway staff:- The Contractor(s) shall not obstruct the Railway staff

directly or indirectly and also the staff working on the Rly. system in any form.

31. Convenience to Railway Staff:

Injury to Railway Staff:- The Contractor shall at all times indemnify the president

against all claims made in respect of the injuries to the persons or public within the

Railway premises made by the contractor(s) his agents or servants during the terms

of contract.

32. Convenience to Railway Staff:

The Contractor(s) will note that in the residential of service building under occupation

they shall take all necessary precautions to avoid any inconveniences to occupants

or against damage to furniture and their property. More than one room may not be

available for completion of the work due leged shall be paid by him to this factor.

33. Subject as otherwise provided in this contract, all notices to be given on the behalf of

the president of India and all other action to be taken on his behalf may be given or

taken on his behalf by the Chief Electrical Engineer, S.C.Railway, Secunderabad.

Laws Governing the Contractor:

34. Laws governing the Contractor:- The Contract shall be governed by the laws of India

for the time being in force.

35. Should the Contractor has relative employed in the Electrical Department of the

Railways he must inform Chief Electrical Engineer, Secunderabad. Of the fact before

signing the agreement failing which is contract may be cancelled if the same

subsequently come to light and he shall be liable to make good any losses or

damage resulting in the case of cancellation under clause 8 A. and 32 A thereof.

36. The marginal notices are not part of the conditions.

37. The contractor shall submit along with final bills the information relating to the wages

paid his labourers in the execution of the works entrusted him.

38. Any individual or individual signing the tender or other document connected with the

contractor should specify whether he is signing.

1. A "Sole proprietor" of the firm or as his Attorney".

2. As "Partner " of the firm or as his "Attorney".

3. For the firm or pre-curretionesm.

In the case limited companies and firm registered under the India partnership etc.,

the capacity in which he is signing should be specified (b) Director managing

Director, Manager, Secretary, partner attorney as the case may be copy of the

document empowering the individuals to sign should be produced if required in the

case of unregistered firm all the partners or any attorney authorises by all of them of

duly authorised by the firm should sign the Tender and all other connected

documents.

39. a. Use of the raw materials secured with Govt. Assistance whether any way raw

materials for the execution of the contract are procured with the assistance of

Government either by issued from Government stocks or purchase under

arrangements made or permit or licence(s) issued by the Government the Contractor

shall hold the said materials economically and solely for purpose of the contract,

against which they are issued and not disposed of the materials without the purchase

all surplus or un-serviceable materials that may be left with him after the completion

of the contract or it is termination for any reason whatsoever on his being paid such

price as Govt. may fix with duly regard to the condition of the materials.

b. The fright charges for the return of the materials according to the directions of the

purchaser for all surplus or unserviceable materials that may be left within after the

completion of the contract of its termination for any reasons whatsoever on his being

paid such price as Govt. may fixed with due regard to the condition of materials. The

freight charges for the return of the materials according to the directions of the

purchaser shall be borned by the contractor, in the agent of the contract being

cancelled for any default on his part. The decision of the Govt. shall be final and

conclusive.

c. In the event of a breach of the aforesaid conditions the contractor shall in addition to

throwing himself open to action for contravention of terms of the licenses of the

permit(s) and or / for criminal breach for trust be liable to account to Govt. for all

moneys, advantages of profits resulting of which the usual course would resulted to

him by reason of such breach.

40. Contractor’s responsibility for discrepancy:

The ultimate responsibility for correct execution of work shall rest with the contractor

unless the Railway insists an option of his designs in spite of the contractor not being

agreeable to it.

41. Work to be done as approved:

i. The planning shall be finalised in consultation with the Railway and approved by

letter in writing before commencement of the work and the contractor shall be held

responsible for the execution of the work in full compliance with approved designs

and drawings. The tenderer’s scheme of work and time schedule shall be furnished

in the Tender.

ii. The contractor shall set out the work and be responsible for the same and amend at

his own cost and to the satisfaction of the Sr. Divisional Electrical Engineer,

Maintenance, Guntakal or his Executives, any errors which may arise.

iii. The contractor shall be responsible for all damages to property and for any injury or

loss caused to the work or workmen, to persons, animals or things in the course of

the work carried out by or under direction of the contractor or his agents.

42. Provisional acceptance:

On completion of the work in all respect the contractor can seek provisional

acceptance certificate for the work completed.

43. Guarantee:

The contractor shall guarantee satisfactory working of the installation, erection by him

for a period of twelve months from the date of commercial operation or from the date

of provisional acceptance by the purchaser whichever is earlier. During the period of

guarantee contractor shall keep available and attend to any defect and replace the

equipment / components resulting from defective erection or defects in the equipment

supplied by the contractor.

44. Indian Labour and Materials:

i. The tenderer shall utilise Indian labour including supervisory staff, for the execution

of this contract to the maximum possible extent.

ii. The tenderer shall be prepared on the basis that all the materials required to

complete the works including those indicated in Schedule-3 are procured from

indigenous sources in full.

45. Works to be done as approved:

The planning shall be finalised in consultation with the purchaser and approved by

the later in writing before commencement of the work and the contractor shall be held

responsible for the execution of the work in full compliance with the approved

designs and drawings. Designs and drawings modified at site by the purchaser’s,

engineers shall be treated as approved. However, such modifications shall be

incorporated in the designs and drawings and re-submitted for formal approval.

46. Monthly Progress Report:

The contractor shall furnish to the Sr. Divisional Electrical Engineer, South Central

Railway, Guntakal or his successor or nominee (whose address will be advised in

due course) during first week of every calendar month, a progress report showing

progress of finalisation of designs, drawings, materials and equipment received at

site and the works carried out during the preceding month and up-to-date progress of

these items along with the total quantum of designs and drawings, materials and

equipments and the works required for the contract.

47. INSPECTION:

Materials: All equipments, materials, fittings, and components will be subject to

inspection by the purchaser or his representative at the manufacturer’s factory before

despatch and no materials shall be despatched from the manufacturer’s factory until

these are inspected and /or approved. The materials may also be inspected by the

purchaser or his representative again at the contractor’s depot. The purchaser or his

representative shall have the right to be present during all stages of manufacture,

and shall be afforded, free of charge, all reasonable facilities for inspection and

testing so as to satisfy him self that the materials are in accordance with

specifications, approved drawings and designs. Any unreasonable delay in

inspection will be reasonable ground for extension of time for completion of the work.

Erection: All erection work will be subject to inspection by the Purchaser or his

representative to ensure that the work is done in accordance with the specification

and approved drawings.

Expenses of purchaser’s representative: All the expenses of the purchaser’s

representative shall be borne by the purchaser whether the inspected materials.

Inspection: The decision of the General Manager or his successor shall be final in

respect of acceptability or otherwise of any material fitting, component or equipment

required for the work.

Correctness of work and materials: The contractor shall be solely responsible for the

correctness of the positions, levels and dimensions of the works according to

approved drawings notwithstanding that he may have been assisted by the

purchaser or his men insetting out the same.

If any dimension figured upon a drawing differs from that obtained by scaling the

drawings the figured dimension should be normally taken as correct unless it is

porima facie a mistake. But all such cases shall be brought to the notice of the

Purchaser’s engineers and the discrepancy set right before execution.

48. Contractor’s responsibility for Discrepancies:

All design and drawings submitted by the contractor shall be based on a thorough

study and shall be such that the contractor is satisfied about their suitability. The

Purchaser’s approval will be based on these considerations. Not with standing

approval communicated by the purchaser, during the progress of the Contract. For

designs and drawings, prototype samples of components, materials, and

responsibility for correct design and execution of work shall rest with the Contractor

unless the Purchaser insists on adoption of his own designs in spite of the Contractor

not being agreeable to it.

The contractor shall be responsible for and shall bear and pay the costs for any

alteration of works arising from any discrepancies, errors or omissions in the designs

and drawings supplied by him, whether such designs and drawings have been

approved by the purchaser or not.

49. Insurance:

The Contractor shall take out and keep in force a policy or policies of insurance

against all liabilities of the Contractor orthe purchaser at common law under any

statute in respect of accidents to persons who shall be employed by the Contractor in

or about the site or the Contractor’s office for the purpose of carrying out the work at

site.

SPECIAL CONDITIONS OF CONTRACT

The following special conditions supplement the "Regulation for tenders and contract

conditions of tender, tender agreement form and general conditions of contract and

should be considered as part of contract paper, wherever the provisions of these

conditions are at variance with the "Regulations for, tender and contracts, conditions

of tender, tender agreement form and general conditions of Contract." the conditions

stipulated in his document shall only prevail upon.

1) The president of India, reserves the right to forfeit the entire Earnest Money Deposit,

should the successful tender fail to furnish the required security deposit as stipulated

in the conditions of tender civil engineering booklet containing regulations for tenders

and contract, conditions of tender agreement form and general conditions of contract.

2) Every effort has been made by the Railway to cover all the items required for

executing the work in the specifications to provide efficient and reliable power supply

arrangements at Railway area. These items have either been covered explicitly or

implicitly in the specification and the tender shall, however, provide free of cost, all

such items that may be required for proper execution commissioning and

performance of the equipments supplied and installed by them whether they are

mentioned explicitly or implicitly in the specification or not. No extra claim,

whatsoever will be entertained by the Railways for such items, so provided by the

contractor for proper execution of for ensuring satisfactory performance of the

installations provided by them under this contract.

3) The contractor shall set out the work and be responsible for the same and amend at

his own cost and to the satisfaction of the Senior Divisional Electrical Engineer/

Guntakal only errors that may through accurate setting out.

4) The tenderer whose tender is accepted shall be required to appear at the office of the

Sr.DEE/M/GTL in person/or if a firm or corporation, a duty authorised representative

shall so appear and execute the contract within 14 days notice after the contract has

been awarded to him. Failure to do so, shall constitute a breach of agreement

affected by the acceptance of the tender inwhich case the Earnest Money Deposit

accompanying the tender shall be forfeited by the Railway as liquidate for such

default.

5) In the event of any tenderer whose tender is accepted shall realise to execute the

contract documents as here infole provided, the Railway may determine that such

tender has abandoned the contract and there upon his tender and the acceptance

thereof shall be not all and avoid and the Railway shall be entitled to forfeit the

earnest money as liquidated for such defaults.

6) The number of equipment and the quantity of cabling indicated either in the drawings

in the schedule of prices requirements are only tentative and the Engineer at site. On

behalf of the Railway shall be entitled by order in writing to enlarge or extend

diminish or reduced the works or make any alterations in quantities to an extent of

25% of the total cost of the tender. In case the agreemental value goes beyond 25%,

for the first 15% increase in the value beyond 25% of agreemental value, the rates

will have a reduction of 2% in the incremental value of the agreement and for the

next 10% increase in the value, rates will have an additional reduction 2% in the

further incremental value of the agreement. Execution of quantities beyond (+)50% of

the overall agreemental value is not permitted. As such, the contractor shall quote

their rates per unit taking also into consideration and no variation in the rates quoted

shall been entertained at a later date, payments will be made on prorate basis.

b. For effecting reduction of rates incremental value shall be considered item wise

subject to over all increase of (+)50% of Agreement value.

7) Time is the essence of contract and the date, agreed upon and specified in the

agreement shall be guaranteed under a penalty clause as specified in clause 4 of the

Civil Engineering booklet containing "Regulations for tender and contracts, conditions

of tender, tender agreement form and general conditions of contract".

8) All the equipments/materials covered by this contract shall comply with the

specifications enclosed and relevant I.S.S. and B.S.S. as required to in the

specifications in all respects and shall be adequate to perform the duties for which

they are designed. The works executed shall conform in all respects, the standard

codes of practices, I.E. Rules and regulations.

9) Maintenance period (a) The maintenance period shall be 12 months from the date of

completion of the work and taking over of the complete installation by Railways after

satisfactory tests and trails. The contractor shall guarantee the equipments supplied

by trails. The contractor shall guarantee the equipments supplied by him against

defective materials/design / manufacturer and faulty workman ship for a period of

12 months. The contractor shall replace at his own cost and any part or parts of the

apparatus of equipment supplied by him, which may within this period, fail to perform

its proper function because of any defects in the design, construction manufacture,

erection of such apparatus/equipment/materials. The contractor shall at all times,

during the progress and continuance of the work and also for the periods of

maintenance and after the date of issue of the completion certificate by the Engineer

or other earlier date subsequent to the completion of the work that may be fixed by

the engineer be responsible for effectively maintain and uphold in good substantial

sound perfect conditions and all and every part of the work as the Engineer shall

require, any damage of defect that may any way connected with the work provided

that such damage or contract document, defect is not directly cause by error in the

act of providence or incurrention or Civil riots and the entire contractor other

personally entitled thereto, whenever required by the Engineer to do so, all losses,

damages, costs and expenses and any of them may incur or be pattor be liable to by

reasons, or Consequence of the operations of his failure in any respect.

b) The Contractor shall also make defect in the equipment/installation this maintenance

period. The work of electrification/ replacement of defective materials shall be

promptly attended to by the contractor within a period of 21 days from the date of

receipt of advices to the effect from the engineer, if any time, the work of

rectification/replacement is delayed by the contractor beyond 21 days the

maintenance period of 12 months shall also stands extended automatically by the

corresponding delayed period taken by the contractor for rectification/replacement if

during the maintenance period the capacity performance of any equipment is found

inadequate/incapable, the contractor shall have the same replaced free of cost

suitable one.

10) In all matters of dispute, the decision of the Chief Electrical Engineer / S.C.Railway /

Secunderabad shall be final and binding.

11) Specifications:- Every effort has been made by the Rlys. to cover all the items

required for executing and various items of works in the respective specifications.

These items might have been covered explicitly or implicitly in the specifications and

the contractors shall however provided free of cost of all such items that they may be

required for proper execution, commissioning are preference of the equipments

supplied and installed by them whether they are mentioned explicitly or implicitly in

this specifications or not no extra claim whether will be entertained by the Railway for

such times so provided by the contractor for proper execution or for executing

satisfactory performance of the Installation provided by them under this contract.

12) Terms of Payments:- The Contractor shall submit his / their bills for payment of 100%

of the completed and commissioned portion of work to the Sr. Divisional Finance

Manager/ S.C.Rly./ Guntakal through Sr.DEE/M/S.C.Railway/Guntakal.

13) No payment shall be made by the Railway to the contractor separately as

reimbursement of excise duty, if any on the equipment or on the finished equipments

when forming part of the contract. The Supply prices are delivery site including freight

and transit insurance the and are NET and FIRM including all duties and taxes.

Necessary Form-D will be furnished by the Railway receipt of the advise from the

contractor.

14) The Chief Electrical Engineer or his authorised representative shall have the right to

refuse admission into the site to any person employed by the contractor(s) whom he

may consider undesirable.

15) The Contractor shall express the greatest care and skill during the process of

dismantling the existing equipment which shall be done in the presence of and to the

entire satisfaction of and authorised representative of the Chief Electrical Engineer

he shall not hamper with a released materials and shall hand over them to authorised

representative and shall fix up suitable dates and timings for these purchase with the

permission of the Chief Electrical Engineer.

16) Cutting away and making good:- The contractor(s) shall carryout the necessary

cutting away and making good for the proposal of the contractor or all wood works,

walls floors etc., of the Railway building. The Contractor(s) shall be responsible and

shall make good at his / their expense to the satisfaction of the president any

damage or disfigurement of the building which may be carried by the acts or

commission of the contractor's agent in connection with the contract.

17) Obstruction to Railways staff:- The contractor(s) shall not obstruct directly or

indirectly the Railway staff on duty and the staff working with the Rlys. System in any

form.

18) Convenience to Railway staff:- The contractor(s) will note that in the residential or

service building being under occupation they shall take all necessary precaution to

avoid any inconvenience to occupations or against damage to furniture and their

property more than one room may not be available at a time for the execution of the

work and in stating the time for completion of the work due regard shall be paid by

him to this.

19) Power:- Subject to or otherwise provided in this contract all notices to being on behalf

of the president of India and all other action to be taken on his behalf may be given or

taken on his behalf by the Chief Electrical Engineer, South Central Railway,

Secunderabad.

20) The contract or shall submit, along with the final bills, the information to the wages

paid to the labourers in the execution of the work entrusted to him.

21) Financial capability:- The Tenderer shall submit document to assure Railway regard

in their financial capacity along with Income tax certificate and any other certificate in

support there of if there forming a vensortium for taking up this work they have also

be submit documents of Agreement reached in this respect, the partnership deed

etc., with the tenderer, since this work is a major work of specimen nature to be

completed within 2 months it is excepted that the tender would have executed works

of similar nature.

22) Stipulation of any special conditions by Tenderer:- The Inspection Officer(s) for this

contract shall be nominated by Railway as indicated in the contract.

22.2 The Contractor shall provided, without any extra cost, to the Railway all materials,

equipments, tools, labour and maintenance of every kind with necessary testing

facilities which the Railway of the inspecting office may consider necessary for any

test and examination to be made at the contractor's or sub-contractor premises and

at site and shall pay all cost attended there on.

23) Certificate of inspection and approval:-

23.1 No equipment/stores will be considered relay for dispatch until the Railway of the

inspecting officer nominated by it shall have certified in writing that they have

inspected and approve by him.

23.2 The inspecting Officer of his authorised representative shall have at all responsible

times, access to the contractor's premises and shall have power to.

23.3 The Contractor shall arrange to conduct all outline test at any time during the

manufacture at manufacturer's premises on in the premises of the sub-contract or at

the site of erection.

23.4 Certify before any equipment is submitted for inspection that it cannot be in

accordance with the contract owing to in satisfactory method employed.

24.1 Completion of work:-

The Contractor shall commence the work from the date of the letter of

acceptance of tenderer is received, and shall complete the work in all respect with

in the stipulated time.

24.2 The Railway attached the utmost importance to the timely completion of the work on

or before the date of contract for in this connection, the attention of the contractor is

specially invited to the clause regarding, liquidated damages and determination of

contract owing to default of contractor provided for and general of contract.

Eligibility Criteria for tenders

[ for open tenders costing above Rs.10 lakh ]

a. Should have completed in the last three financial years (i.e., Current year and three

previous financial years) –

- At least one similar single work, for a minimum value of 35% of

advertised tender value during the period from 01.04.2004 to 31.08.2007.

b. Total contract amount received during the last three financial years and in the current

financial year –

- Should be a minimum of 150% of advertised tender value. Documentary

evidence in terms of same to be furnished by the tenderers along with the

offer i.e., from 01.04.2004 to 31.08.2007.

3.0 The following documents shall be submitted along with tender to fulfil

minimum eligibility criteria:-

3.1 Tenderer should submit an attested copy of certificate obtained from Jr. Administra -

tive Grade Officer of Electrical department of Railway / Superintendent Engineer of

State Government of equivalent grade officer in Quasi Government department /

Public Sector undertakings in Central to the Eligibility criteria. Description of work,

organization for whom executed, value contract at the time of award, date of Award,

value of contract. If the work is completed but final bill not paid, details as required

to shall be made available. Certificate from Private Individuals from whom such

works are executed shall not be considered

3.2 Attested copy of Revenue Solvency certificate issued by MRO and Bankers Solvency

issued from Nationalized/Schedule Bank shall be considered. The date of issuing

the solvency by Revenue/Bank shall not be older than one year from the date of

opening of tender.

3.3 Attested copy of certificate from Jr.Administrative Grade Officer of Electrical

department of Railways/Superintendent Engineer of State Government or equivalent

grade officer in Quasi Government received during the last 3 financial years and in

the current financial year. Audited balance sheet indicating agreement wise contract

bills received during the last 3 financial years duly signed and certified by the

Chartered Accountant also can be enclosed.

3.4 List of works on hand indicating name of work, contract value, Bill amount paid so

far, due date of completion etc, to be furnished by contractor and this certificate to

be signed by contractor.

3.5 The bonus of establishing credentials lies with the tenderer and hence Railway

shall valuate the offer only from the certificates/documents submitted along with the

tender offer.

3.6 Any Certificates, documents submitted after tender opening shall not be given any

credit and shall not be considered.

3.7 The offer of tenderer(s) who do not enclose Solvency Certificate, Experience

Certificate, Turnover Certificate and list of works in hand as 2.1 to 2.4 along with

their tender to establish their credentials shall be summarily rejected though they are

working contractors or contractors of approved list.

4.0 The following further documents may be submitted along with tender:-

4.1 List of Personnel organization available on hand and proposed to be engaged for the

subject work. These two lists should be given separately and signed by tenderer. List

of plant and machinery available on hand (own) and proposed to be inducted

(own and hired to be given separately) for the subject work and this list shall be

signed by tenderer.

4.2 List of works completed in the last three financial years giving description of work,

organization for whom executed, approximate value of contract at the time of award,

date of award and date of scheduled completion of work, date of actual actual start,

actual completion and final value of contract should also be given.

5. If any Certificates or details enclosed by tenderers are found to be

fake/bogus/tampered, such of those agencies shall not be awarded any work in

S.C.Railway for a period of 5 years from the date of opening of tender. Joint

ventures or partnership firms or any other nature of firms in which such agencies are a

party shall also not be awarded any work for this period of 5 years.

6. Performance Guarantee:

a The successful bidder should give a performance Guarantee in the form of an

irrevocable bank guarantee issued by any Nationalized or Scheduled Bank

amounting to 5% of the contr5act value as contained in Sl.No.3 if amendment of

GCC advised vide Railway Board letter No.2003/CE-I/CT-4/Pt.I dated 12/16-5-

2006

b. Time period for submission of performance guarantee: The performance

Guarantee should be furnished by the successful contractor within 15 days from

the date of issued of the letter of acceptance, but before signing of the agreement

and should be valid upto expiry of the maintenance period.

c. Performance Guarantee should be released after satisfactory completion of the

work and after completion of the maintenance period.

7. Conservancy Charges: As applicable from time to time to be levied (C1.6 of GCC

& C.S.No.5.0 FCC)

8. Joint Ventures/Consortium Agreements/MOUs shall not be considered:

Partnership deed is eligible if entered into and registered prior to Tender Notice.

Tenderer should enclose/submit experience certificate in the same name and style as

the tenderer & other credentials shall be considered fully to the extent of work

executed by the partnership firm (Experience of individual partners will not be

considered)

9. The tender form in the prescribed proforma may be obtained from the office of the

Divisional Railway Manager/Electrical, South Central Railway, Guntakal on production

of Cash receipt of each tender from at the rates mentioned above. Rs.50/- should

be paid extra for each tender, if the tender form is required to be sent by post. The

amount towards the cost of Tender form may be remitted to the Divisional

Cashier/Pay/South Central Railway.Guntakal (or) to any Station Master on South

Central Railway. The receipt obtained thereof, should be submitted to the office of

the undersigned with the requisition for issue of tender form. The cost of the

tender form is not refundable. FDRs towards EMD are to be drawn in favour of

Senior Divisional Finance Manager/South Central Railway.Guntakal on the account

of Tenderer

10. Tenderers can also down load the tender form from the web site Indian Government

Tender Portal for the purpose of perusal and to use the same as tender document if so

desired.

11. Those who are participating in the tender with down loaded copy from the web site

shall enclose a separate DD/PO/BC drawn in favour of Senior Divisional Finance

Manager, South Central Railway,Guntakal or Money receipt obtained from Divisional

Cashier Pay/Guntakal towards the cost of the tender form without which the tender

shall be treated as invalid. Separate Bank instruments/Money receipts should be

enclosed for EMD and cost of tender form in case of downloaded tender documents.

FDRs will not considered towards cost of tender form.

12. Contract agreement will be prepared based on the master copy of the tender document

available in DRM(Electrical) Office/Guntakal and will be binding on the contractor.

The Railway does not own any responsibility for any alteration/omission in the

contents of the Tender document either while uploading on to web site or otherwise.

No claim on this account will be entertained. The administration will not own any

responsibility, if the web site is not opened for down loading the tender documents

due to any technical snag.

13. The prospective tenderers are advised to visit the web site one week before the

date of tender opening to note any changes/corrigenda of any tender

WARNING: It is hereby brought to the notice of all prospective tenderers that if any

change/additions/deletions/.alterations are found to be made by them in the tender

form and the same is subsequently detected/noticed at any stage even after award of

the contract, suitable action including banning of business with them would be taken.

Note:

1 Prior written approval should be obtained for the materials that are being used for the work before

erection from nominated Railways representative.

2 The tenderers are advised to inspect the site(s) before quoting.

3 The contractors are advised to visit the site(s) and submit cable route diagram and get it approved

4 Tenderers shall specifically mention the brands offered and relevant technical details, specifications,

catalogues and leaflets etc., wherever applicable, should invariably be enclosed, so as to evaluate their

5 The exact location of the work will be shown by the Engineer at site. After marking is given, schematic

diagram shall be prepared and submitted to Senior Divisional Electrical Engineer's office for approval.

Work shall be taken up based on the approved drawings only.

6 All damages during the work to men and materials (Railways or otherwise) shall be made good by the

contractor at his own cost. Otherwise recovery will be made from the bills.

7 All the fittings / equipments should be CEE approved makes only and to be purchased from the

Original Equipment Manufactureror authorised dealers only. Authorised dealer ship certificate shall be

submitted. The makes proposed to be procured for all the items shall be submitted and got approved

before placing orders.

8 All the released materials have to be handed over to Section incharge in the condition in which they

are. Before releasing, list to be prepared, jointly signed by Contractor Representative and Rlys

Representative and submitted to Sr.DEE's Office for approval

9 The contractor shall invariably quote the rate separately for Schedule-B1 and Schedule-B2 [RC items].

However, in case of Schedule-B2 [RC items], if the rate quoted is on higher side then only rate as

indicated in the Schedule-B2 will be considered.

10 The rate is inclusive of all taxes, Excise duty, Octrai etc.,

11 For supply items if original bills / invoice are submitted duplication of Tax will be avoided.
